Crime Survivor Rights in Plain Language
Are you a survivor of crime? If you are, you have rights. These are your rights.
You have the right to be told ahead of time about court proceedings in your case.
You have the right to be at court proceedings in your case.
You have the right to know what punishment the defendant gets.
You have the right to be protected from the defendant.
You have the right not to speak to the defendant or defendant’s attorney before trial. You also have the right not to give them any documents or other information before trial.
You have the right to receive restitution from the defendant. Restitution is payment for specific costs you incurred that are directly related to the crime where you have documentation.
In some cases, you have the right to speak to the district attorney about plea negotiations. This is when the district attorney and defendant agree about the punishment without a trial.
You have the right to have a support person with you throughout the criminal process.
You also have the right to be treated fairly and with respect. This means that you must be given a meaningful role in the criminal justice process. If you have questions about these rights, or feel like these rights were violated, please contact us.
